Terms & Conditions

These Terms & Conditions outline important information about ordering, delivery, cancellations, and product care for Sun & Moon Balloon Design.

By placing an order with Sun & Moon Balloon Design, you acknowledge that you have read, understood, and agreed to the following Terms & Conditions in full.

Website Use & Intellectual Property
All content on this website, including but not limited to text, images, product names, designs, graphics, logos, branding elements, and layout, is the property of Sun & Moon Balloon Design and may not be copied, reproduced, distributed, modified, or used without prior written consent. Unauthorized use may violate copyright, trademark, and other applicable laws. While we strive to ensure this website is accessible and up to date, we do not guarantee uninterrupted access and are not liable for temporary downtime, maintenance interruptions, or technical issues beyond our control.

Order Confirmation & Payment
All orders must be paid in full at the time of purchase. Orders are considered confirmed once payment has been successfully processed. We reserve the right to decline or cancel any order at our discretion. Requests for changes must be submitted in writing and cannot be guaranteed once production has begun.

Delivery Policy & Recipient Responsibility
Delivery times are provided as windows. Specific delivery times are not guaranteed. While we make every effort to deliver within the selected timeframe, traffic, weather, building access, third-party carrier delays, and other unforeseen circumstances may impact timing. We appreciate your understanding when delays occur outside of our control.

It is the customer’s responsibility to provide accurate delivery information and to ensure the recipient is available to receive the order. If the recipient is unavailable, refuses delivery, provides incorrect information, denies access, or cannot be located, the order will be considered fulfilled and is non-refundable. Additional delivery fees may apply if re-delivery is requested.

At the purchaser’s request, deliveries may be sent anonymously. For privacy and security reasons, we will not disclose purchaser information to recipients or third parties without written consent from the purchaser unless required by law. If a recipient refuses delivery because they do not know the sender or the sender did not disclose their identity, the order is considered fulfilled and non-refundable.

For hospitals, schools, corporate buildings, and other secured or public facilities, deliveries will be made to the front desk, reception area, or designated drop-off location as determined by the facility. We are unable to guarantee delivery directly to patient rooms, classrooms, offices, or secured internal areas. Once delivery has been accepted by facility staff or left at the designated location, responsibility transfers to the recipient and/or facility.

Venue & Access Requirements
If a delivery location has specific policies, security procedures, delivery restrictions, or time limitations, it is the customer’s responsibility to communicate those requirements in advance. Sun & Moon Balloon Design is not responsible for delays or failed deliveries resulting from undisclosed venue restrictions.

Indoor Use & Environmental Conditions
Unless otherwise stated, balloon products are recommended for indoor use only. Outdoor exposure may significantly reduce float time and structural integrity due to wind, heat, cold, humidity, precipitation, debris, and surface temperatures. While balloons are designed to be celebratory and joyful, they are sensitive to environmental conditions beyond our control, and longevity cannot be guaranteed once exposed to those conditions.

Transfer of Responsibility
Once an order has been delivered and accepted, responsibility transfers to the customer or recipient. Sun & Moon Balloon Design is not responsible for damage, popping, deflation, discoloration, staining, structural changes, or loss occurring after delivery due to handling, environmental exposure, ceiling interference, pets, children, or relocation of the installation.

Damage Claims
We want every delivery to feel seamless and beautiful, and we take great care to ensure each product leaves our studio in excellent condition. If an item appears damaged, defective, or incorrect at the time of delivery, we must be notified immediately at the time of receipt so the concern can be evaluated and addressed promptly. If you are not present at delivery, responsibility transfers upon acceptance of the order at the delivery location.

Balloon products are highly sensitive to temperature and environmental changes. Helium-filled balloons may temporarily appear soft or slightly deflated in cooler temperatures and will re-expand when returned to room temperature. Exposure to heat may cause balloons to expand or pop. Changes in appearance due to temperature shifts, transport, relocation, or environmental exposure do not constitute defects.

Because balloon products are perishable and sensitive to handling, we are not responsible for damage, popping, deflation, distortion, or loss that occurs after delivery due to movement, transport, outdoor exposure, ceiling interference, pets, children, or misuse. Determinations regarding defect versus post-delivery damage are made at our reasonable discretion.

Customization & Creative Discretion
All customized and personalized products are artistic interpretations. While we carefully curate selected colors, themes, and inspiration references, minor variations in layout, spacing, balloon shade, sizing, foil design, and execution may occur. Foil balloon designs may vary based on availability but will remain within a coordinating theme and colorway. By placing a custom order, you grant Sun & Moon Balloon Design creative discretion in achieving the overall design intent. Customer-submitted errors including spelling, names, dates, or messages are not eligible for refund or correction once production has begun.

Perishable Goods & No Returns
Balloon products are perishable, time-sensitive goods and cannot be returned, reused, or resold once inflated or delivered. For this reason, we do not accept returns of inflated or personalized items.

Cancellations & Refunds
Orders may be cancelled for a full refund if cancellation is requested at least seven (7) calendar days prior to the scheduled delivery or pickup date. For example, an order scheduled for January 8 must be cancelled no later than January 1 to qualify for a refund. Cancellations made within seven (7) days of the scheduled date are non-refundable. Once production has begun, orders are non-refundable. Completed and delivered products are non-refundable.

Promotional Codes
Promotional codes are valid only on the Sun & Moon Balloon Delivery website unless otherwise stated. Codes may not be combined with other offers unless explicitly permitted. Promotional codes are not redeemable on orders placed prior to the code being issued and may be modified or withdrawn at any time.

Safety & Liability
Balloons and balloon components may present choking hazards and are not toys. Adult supervision is required around children. Individuals with latex allergies should avoid contact with latex balloons. By purchasing, you acknowledge and accept the inherent risks associated with balloon products. Sun & Moon Balloon Design is not responsible for allergic reactions, medical events, choking incidents, or injury resulting from improper handling, supervision, or use after delivery. Nothing in these Terms & Conditions limits liability where it cannot be excluded under applicable law.

You agree not to intentionally release helium-filled balloons into the atmosphere. Responsible disposal is strongly encouraged. Upon delivery, responsibility for proper handling and disposal transfers to the customer.

Force Majeure
We are not liable for failure to perform or delay in performance due to events beyond our reasonable control, including but not limited to severe weather, natural disasters, government actions, supply chain disruptions, labor shortages, transportation failures, or other unforeseen circumstances.

Indemnification
You agree to indemnify and hold harmless Sun & Moon Balloon Design from claims, damages, liabilities, costs, or expenses arising from the handling, possession, misuse, release, or disposal of balloon products after delivery.

Communication & Data Protection
For privacy and security purposes, we will communicate order details only with the purchasing customer. By placing an order, you consent to the collection and processing of your personal information for order fulfillment and legitimate business operations in accordance with our Privacy Policy.

Nothing in these Terms & Conditions limits any rights you may have under applicable federal, state, or local consumer protection laws.
